When the decision is made that the marriage is irreparable but it is clear that the issues in dispute renders an uncontested divorce unlikely, consider divorce mediation. Although mediation is slightly more costly than an ordinary uncontested divorce it is remarkably less costly than litigation.

One fundamental advantage of mediation versus litigation is that the parties remain in control with mediation. It is not left up to a judge to determine and therefore far less risky. The bonus is also that neither party loses their right to court. At any time during the mediation proceedings one or both parties may look for recourse in the courts through the conventional manner.
Mediation will ensure that the parties retain their sense of pride, self-worth and the relationship with each other where litigation may be extremely emotional and stressful and can literally destroy any future prospect of a healthy relationship between the parties.
